The essentials, in six sentences
- There are two ways to use Visionauta — anonymous and with an account — and the difference between them is exactly what we keep.
- In anonymous mode, we keep no content of yours and no sensitive data. No photo, no recording, no transcript, no memory. What we do record is technical operating statistics — for example, the device code, quota counters, which features were used and the access logs the law requires us to keep — nothing that tells what you saw or said.
- Visionauta's essential features are available both with and without an account. The account enables the enhanced experience — such as the assistant's memory across sessions —, which by its very nature depends on storing the conversations; and plans and quotas may be different between the two modes.
- With the Visionauta Account, we keep — on encrypted servers — the images your camera captured, the audio of your voice, the transcripts of the conversations, memories across sessions, device sensor data (such as gyroscope, accelerometer, compass and battery level) and your location, when you share it, and we analyze this data to improve the app. Creating the account is authorizing this, and it is written on the account creation screen itself, before you decide. The account is for people over 18.
- Using your data to train the artificial intelligence models is another decision, separate and optional: a switch that comes turned off and that you turn on only if you want to.
- Deleting the account erases what we kept — except what the law requires us to retain for a fixed period, and we say exactly what and for how long. Erasing data or the account is done with a button inside the app or through a page on our website.
The rest of this document explains each of these points and everything else we do with your data.
1. Who is responsible for your data
The controller of your data is:
Refactoring Soluções em Tecnologia LTDA CNPJ 47.489.920/0001-89 Address: Rua Cayowaa, 575, apto 131 — Perdizes, São Paulo/SP Website: www.tensorial.com.br General e-mail: contato@tensorial.com.br
Tensorial is the group's brand. Visionauta is a product of the company.
Data Protection Officer (DPO)
Jonathan da Silva Santos Contact channel: privacidade@tensorial.com.br
The officer receives complaints from data subjects and from the ANPD (Brazil's National Data Protection Authority), provides clarifications and takes action. Write to that address about any privacy matter.
2. The two ways to use Visionauta
This is the most important decision you make about your data, and it deserves a section of its own. Visionauta has two modes, and you are the one who chooses.
2.1 Anonymous mode — no content, no sensitive data
This is the default mode. You open the app and use it. There is no sign-up, no login, no e-mail. You are identified by a device code — we do not know your name, your CPF (Brazilian taxpayer number) or your e-mail, unless you write to us.
In this mode, we keep no content of yours and no sensitive data:
- No photo and no video of what your camera captured.
- No recording of your voice.
- No transcript of your conversations.
- No memory from one session to the next — every conversation starts from scratch.
When you ask a question, the image and the audio are processed by the artificial intelligence models to generate the answer at that moment and are discarded right afterwards.
What we do record in anonymous mode is technical operating statistics, with no content and without identifying who you are: the device code, quota counters, statistical usage events (which features, when) and the access logs the law requires us to keep (IP address, date and time — art. 15 of the Marco Civil da Internet, Brazil's Internet Civil Rights Framework). None of that tells what you saw, showed or said. The table in section 4 lists each item.
2.2 Account mode — what we keep, and why
If you create a Visionauta Account — with e-mail and password, with Google or with Apple —, the way things work changes, and it changes because that is what the account is for. With the account, we keep, on encrypted servers:
- The images your camera captured during the conversations.
- The audio of your voice during the conversations.
- The text transcripts of what you said and of what the assistant answered.
- Memories in text extracted from the interactions, so the assistant can remember you from one session to the next.
One exception is left out of all of this: screen sharing. When you share your screen during a real-time conversation, the images of the screen are not stored under any circumstance — neither in anonymous mode nor with the Visionauta Account. They are used only for the assistant to describe, live, what appears on the screen at that instant, and they are discarded right afterwards: they do not go into the archive, they do not become memories across sessions, they are not used to train models and they are not recorded anywhere at all. Because the screen may contain a password, banking data or someone else's private message, this strict rule always applies. The audio of your voice during the conversation follows the normal regime of this section.
And we do two things with this data:
- Serve you: give continuity to the conversations, remember your preferences, improve the answers you receive.
- Analyze it to improve Visionauta: find and fix errors of understanding and of description, understand risky situations experienced by the people who use the app, and develop the product. This analysis is carried out by our team, under a duty of confidentiality, and by our systems.
The account also authorizes the storage and the analytical processing of device sensor data — such as gyroscope, accelerometer, compass and battery level — and of your location, when you share it, whether approximate, precise or inferred, in order to improve the app. On this, a word of candor about verb tense: the collection of motion sensors is not implemented yet — today the app does not read the gyroscope, the accelerometer or the compass. We are declaring it from now because we intend to use them (for example, to understand whether a wrong description coincided with the camera being in motion) and because you have to know this before creating the account, not afterwards. Location is already used today to regionalize the experience and to answer questions about places; with the account, it may also be kept and analyzed together with the rest.
Numerical derivatives of this data may also be kept — for example, what are called embeddings, summaries in numbers that the artificial intelligence models use in order to work. One of these derivatives cannot be turned back into the original photo or sound by the technical means available to us today, but we do not treat it as anonymous: the LGPD (art. 12) calls this pseudonymized data, and we protect it as personal data — sensitive data included — under the same rules as the data it came from.
Creating the account is authorizing everything that is in this section. The text you see on the creation screen says so in so many words, and section 3 reproduces it. What the account does not authorize is training artificial intelligence models with your data — that is a separate switch, optional and off by default, explained in section 3.
And what if you prefer not to have an account? Visionauta's essential features remain available in anonymous mode, without any content of yours being kept. The account exists for those who want the enhanced experience — an assistant that remembers you and evolves with use — and that experience depends, by its very nature, on storage: without keeping the conversations, there is nothing to remember. Plans and quotas may also be different between the two modes (Terms of Use, section 3). And the account is for people over 18.
2.3 Where this data is kept
Your account archive — images, audio, transcripts and memories — is kept on servers in Brazil (Google Cloud, São Paulo), encrypted at rest and in transit, in an area with access restricted to authorized team members. Section 9 details security; section 6 says who else receives what.
3. The authorizations, one by one
3.1 The account authorization
On the account creation screen, you give a single acceptance that covers the logged-in regime: you reaffirm that you have read and accept the Terms of Use and this Privacy Policy — presented again prominently, because creating the account changes the regime of your data — and you give the specific and prominent consent for the storage and the analysis described in section 2.2. The text that appears on the screen is this one, and it is the same one that applies here:
Your account makes Visionauta remember you
With the account, the assistant keeps your conversations — images, audio, transcripts and memories — securely and encrypted, in order to give continuity from one session to the next and to improve Visionauta. Location data and device sensor data may also help with that improvement. Everything stays under your control: deleting the account erases what was kept. And training the artificial intelligence with your data only happens if you turn on a separate switch, which comes turned off. Would you rather not keep the conversations? Continue without an account — the essentials of Visionauta work just the same.
And the confirmation you check is this one:
I confirm that I am over 18 years old, that I have read and accept the Terms of Use and the Privacy Policy and that I agree with the account as described above.
The screen text is deliberately short and says the essentials; the full detail — exactly what is kept, for how long, what the law obliges us to retain — is in this Policy, in sections 2, 5 and 10, accessible from that very screen. If one day the two texts disagree, what is on the app screen prevails — that is what you read when you decided.
Because what the camera sees and what you say may contain sensitive data — a medicine, a document, a health condition —, this consent is requested in a specific and prominent way, as required by article 11, item I, of the LGPD. Section 4 explains why it can be a condition of the account without being flawed consent.
Withdrawal. The way to withdraw this authorization is to delete the account — because it is not an extra hanging off the account: it is what the account does. Deleting the account erases the archive (section 10) and returns you to anonymous mode: the essential features continue; what ceases to exist is what depends on storage — the assistant's memory and the other account features.
3.2 The artificial intelligence training switch — separate and optional
Independently of the account authorization, there is a second decision, and it is yours alone: allowing the data kept in your account to be used to train and fine-tune Visionauta's artificial intelligence models.
The text that appears in the app is this one, and it is the same one that applies here:
Train the artificial intelligence (optional)
If you turn on this switch, the data kept in your account — images, audio, transcripts and memories — may also be used to train, fine-tune and evaluate Visionauta's artificial intelligence models. The switch comes turned off. You can turn it off whenever you want: turning it off stops your data from being used in training from then on, but it does not undo training that has already happened. Conversations of people under 18 are left out of training. Turning it on or not does not change any feature of the app.
Rules for this switch:
- It comes turned off by default. If you do nothing, your data trains no model at all.
- It is not a condition for anything. Not for the account, and not for any feature of the app.
- It can be turned off at any time, in the account Settings.
- Withdrawal applies going forward. A model that has already been trained does not unlearn. Turning the switch off prevents your data from entering any training from that point on — but it does not undo training that has already happened. We are saying this now, before you decide, because it is the kind of thing nobody wants to find out afterwards.
- Data of people under 18 trains no model at all. The Visionauta Account is for people over 18 (Terms, section 1); if we find out that an account was created by a minor, it is closed and the data is deleted.
- We do not sell and we do not transfer. Your data is not sold, licensed or handed over to third parties for them to train their own models. The training is of Visionauta's models.
3.3 And in anonymous mode?
There is no authorization to give, because nothing is being kept. Earlier versions (never published) of this policy provided for an optional switch that allowed transcripts to be kept without an account. It no longer exists. Anonymous mode is now a promise with no asterisk: none of your content is kept, switch or no switch — because there is no switch.
4. What data we process, what for, and on what legal basis
Each row is a different processing operation, with a rule of its own.
In both modes
| Data | What for | Legal basis |
|---|---|---|
| Camera image and your question, during the conversation | Describe what is in front of you and answer at that instant | Performance of a contract (art. 7º, V) |
| Microphone audio in the real-time conversation | Understand what you say and answer by voice | Performance of a contract (art. 7º, V) |
| Location (when you share it) | Regionalize the experience; answer questions about places | Performance of a contract (art. 7º, V) |
| Device identifier, IP address, usage counters | Apply quotas and protect the service against abuse | Legitimate interest (art. 7º, IX) |
| Application access logs (IP address, date and time) | Mandatory retention under the Marco Civil da Internet (art. 15) | Legal obligation (art. 7º, II) |
| App usage events (which features, when) | Product metrics | Legitimate interest (art. 7º, IX) |
| Notification token | Send product notices and notices of policy changes | Legitimate interest (art. 7º, IX) |
| Subscription data | Activate and maintain Visionauta Plus | Performance of a contract (art. 7º, V) |
| Tax records of the subscription | Comply with tax and accounting obligations | Legal obligation (art. 7º, II) |
In anonymous mode, that is all. The content — image, audio, transcript — appears in the first and in the second rows because it is processed during the conversation; it is not kept in any case.
Only in account mode
| Data | What for | Legal basis |
|---|---|---|
| E-mail, password and user identifier | Create your account, authenticate you and allow password recovery | Performance of a contract (art. 7º, V) |
| Basic data from the Google or Apple profile (only if you sign in with them) | Create and authenticate your account | Performance of a contract (art. 7º, V) |
| Camera images, voice audio and transcripts, stored | Serve you (continuity, quality) and analyze in order to improve Visionauta | Specific and prominent consent (art. 11, I), given when the account is created |
| Memories in text across sessions | For the assistant to remember you | Specific and prominent consent (art. 11, I), given when the account is created |
| Device sensors (such as gyroscope, accelerometer, compass and battery level — when implemented) and location (when you share it), stored and analyzed | Improve the app | Specific and prominent consent (art. 11, I), given when the account is created |
| Numerical derivatives (embeddings and the like) of the data above | The same purposes as the source data | The same basis as the source data |
| All of the data above, used in model training | Train, fine-tune and evaluate Visionauta's AI models | Prominent, separate and optional consent (art. 11, I) — the training switch in section 3.2 |
Sensitive data: why the account consent can be mandatory without being flawed
The content you send — the image of your surroundings, of your documents, of your medicines, and your voice — may contain sensitive personal data as defined by the LGPD. And the very fact that you use Visionauta suggests visual impairment, which the law also treats as sensitive data. Sensitive data has a rule of its own: article 11 requires specific and prominent consent.
Accepting the Terms and this Policy is a condition for using the app — in both modes —, because processing the image in order to describe what is in front of you is not an extra: it is the product. And the storage consent is a condition for having the account, by the same logic: an account whose purpose is for the assistant to remember you is, by its very nature, an account that keeps. The law obliges us to say this prominently before you decide (art. 9º, §3º), and that is what this section and the creation screen do.
It may seem contradictory: if consent has to be free, how can it be mandatory? The answer is the structure of everything you have read so far:
Consent is flawed when someone ties to the service a purpose that has nothing to do with it. That is not the case here: the storage is necessary for what the account offers — an assistant that remembers you only exists if the conversations are kept; there is no way to provide that service without that processing. And refusing does not shut anyone out of Visionauta: the essential features remain available in anonymous mode, with no content kept. Whoever creates the account is not being pressured — they are choosing, between two honest modes, the one whose nature is to keep. And the only thing that remains optional inside the account is precisely the one that is not part of its nature: model training, which has its own switch, turned off.
We are frank about what this is: the reading above is ours, grounded in articles 11, I and 9º, §3º of the LGPD. It is not a decision of an authority or of a court. We wrote out the whole reasoning, instead of just stating the conclusion, so that you can assess it — and so that, if it is ever challenged, it is clear what we think and why.
How you are identified
Without an account — a device code. We do not know who you are.
With an account — your e-mail and a user identifier; if you sign in with Google or with Apple, also the basic data from the profile (name and e-mail). Nothing beyond that. The account does not exist to build a customer database or for advertising.
About legitimate interest
We use legitimate interest in three cases: usage metrics, notifications and security of the service. In none of them does the content of your questions or of the answers travel. You can object to this processing by writing to privacidade@tensorial.com.br.
5. For how long we keep it
| Data | Period |
|---|---|
| Content in anonymous mode (image, audio, transcript) | Not kept |
| Account archive (images, audio, transcripts, memories, sensors, location and derivatives) | For as long as the account exists; erased when you delete the account |
| Memories across sessions | For as long as the account exists; automatically erased after 180 days without use of the service, and immediately upon deletion of the account |
| Account data (e-mail, user identifier) | For as long as the account exists; erased when you delete the account |
| Application access logs (IP address, date and time) | 6 months (obligation under art. 15 of the Marco Civil da Internet — applies even after a deletion request) |
| Technical and security records (application logs) | 90 days |
| App usage events | 2 years |
| Tax and subscription data | 5 years (legal requirement) |
| Record of your authorizations and of your deletion requests | For as long as the relationship lasts, plus the statutory limitation period |
The record of the authorizations is kept because the law places on us the burden of proving that they existed (art. 8º, §2º). It keeps the date, the version of this document and the state of each option — not the content of your conversation.
6. Who the data is shared with
Visionauta uses third-party services in order to work. Below is the complete and real list. None of them buys your data: they are companies hired to carry out a task on our behalf.
They receive content (image, audio or text of the conversation) — in both modes, during the conversation
| Company | What it receives | Country |
|---|---|---|
| Camera image, audio and text of the conversation | USA | |
| Groq | The audio of your voice and text of the conversation | USA |
| Cloudflare | Camera image and descriptions of what it shows | USA |
| SiliconFlow | Camera image | China |
| DeepSeek | Text of the conversation, to generate and query memories and descriptions | China |
| xAI | Text of the answer, to turn it into speech | USA |
| Apple | The audio of your voice, in the iPhone's speech recognition | USA |
These transmissions happen in order to generate the answer, at the moment of the conversation, in both modes. What changes between the modes is not who processes: it is what we keep afterwards. Your account archive is not handed over to any of these companies — it stays on our servers in Brazil.
Note about xAI. xAI does not receive your voice, does not receive the camera image and does not receive your device identifier. It receives only the text of the answer, in order to turn it into sound. Even so, we list it: when you ask to have a letter read, the answer is the letter, with a name and an address inside it. We have no way of separating the two cases, so we treat both by the stricter standard.
They receive only technical data, with no content
| Company | What it receives | Country |
|---|---|---|
| Google (Firebase) | Notification token, device code, language | USA |
| Google (Firebase Authentication) | E-mail, access credentials and user identifier — only if you create an account | USA |
| Google (Google Sign-In) | Basic data from your Google profile — only if you sign in with it | USA |
| Apple (Sign in with Apple) | Basic data from your Apple profile — only if you sign in with it | USA |
| Google (Play Billing) | Data of your subscription | USA |
| Apple (StoreKit) | Data of your subscription | USA |
| Meta (glasses SDK) | The SDK's own telemetry — see the note | USA |
Note about the account. Your password does not stay with us: the one that keeps and verifies the credential is Google's Firebase Authentication. What reaches our servers is the confirmation that the login is valid, with your e-mail and the user identifier. The account archive — images, audio, transcripts, memories — does not go to any of those login services: it stays on our servers in Brazil.
Note about Meta. Visionauta integrates with Meta's Ray-Ban glasses. The images from the glasses do not go to Meta's servers through our application: they pass through our server, like any other image. However, the Meta component embedded in the Android app has a telemetry system of its own, which sends Meta data such as the device model, the system version and session identifiers.
To be direct: that component starts every time the Android app opens, including on the device of someone who has never used the glasses. In other words, if you use Visionauta on Android, it is likely that Meta receives this technical data even if you have no glasses at all. It is not images, it is not audio and it is not the content of your conversations — but it is a transmission to a third party, and you have to know that it happens.
We have no way of inspecting what that component does on the inside: it is closed. What we describe here is what we were able to determine by analyzing it.
Where our own servers are
The database and the account archive are in Brazil. The device identifiers, the quotas, the subscription data, the consent record and — if you have an account — the images, the audio, the transcripts and the memories are kept in São Paulo (Google Cloud). The server that processes your requests, and the one for the real-time conversation, are also in São Paulo.
| Where it runs | Region |
|---|---|
| Database and main server (Google Cloud) | São Paulo, Brazil |
| Real-time conversation server (Google Cloud) | São Paulo, Brazil |
| Account archive (Google Cloud Storage) | São Paulo, Brazil |
Section 7 deals with transfers out of the country.
We may also share
- When the law, a regulation or a court order requires it.
- To protect the rights and the safety of the users and of the service.
- In the event of a merger, acquisition or sale of the company (in whole or in part): your data may be transferred to the successor as part of the transaction, and the successor assumes the obligations of this policy under the terms of the law. You will be notified in advance and will be able to exercise your rights — including deleting your data or your account — before the transfer.
We do not sell, we do not rent and we do not transfer your data for advertising. The only exception is the one in the list above: in a merger, acquisition or sale of the company, the data may be part of the transaction — with the notice and the safeguards described there.
7. International transfer
Part of your data leaves Brazil.
The services listed in section 6 are outside the country: most of them in the United States, and two of them in China. When you use Visionauta, the content that needs to be processed by them crosses the border — in both modes, during the conversation.
Section 6 says exactly who these companies are and what each one receives. There are none beyond those.
If you create an account, its data — e-mail, credentials and user identifier — is kept in Google's Firebase Authentication, in the United States. The account archive is not: images, audio, transcripts and memories stay on our servers in Brazil and are not transferred abroad for storage.
Our own servers are in Brazil, including the database and the account archive (section 6).
8. What runs inside your device
A good part of Visionauta works without sending anything anywhere: reading text by OCR, identifying banknotes, local synthesized speech and translation. The history of your conversations is kept on your device; with the Visionauta Account, the conversations are also kept on our servers, as part of the archive described in section 2.2 — that is what makes memory across sessions possible. Processing on the device whatever can be processed there is deliberate minimization.
About the Android backup. The Android system automatically backs up application data to your account's Google Drive. The history of your conversations with Visionauta is excluded from that backup: it does not leave the device by that route. The decision was this one because a copy on your Drive would be a copy that we do not control, that our retention does not reach and that "delete my data" would not be able to erase.
The direct transfer from one device to another, when you change phones, still carries the history — there the data goes from your hand to your hand, with nobody's server in between.
9. Security
What we do today:
- Content encrypted in transit, always.
- The account archive is encrypted at rest, in a dedicated bucket, with access restricted by infrastructure permissions — it is not an open directory on just any server.
- Access keys to the models stay on the server, never on your device.
- A closed list of permitted destinations: the app cannot send data to a service that is not on that list.
- Real-time sessions use temporary credentials.
- Our own infrastructure in Brazil.
- Separation between archives: the account storage, the memories and the technical records live in separate areas, with separate permissions.
- Access restricted to authorized team members, under a duty of confidentiality.
What we do not promise: no system is completely secure. If there is an incident with relevant risk, we will notify you and the ANPD, within the deadline of Resolution CD/ANPD 15/2024.
10. Your rights
The LGPD gives you, in article 18, the following rights:
- To know whether we process your data.
- To have access to your data.
- To correct incomplete or wrong data.
- To request anonymization, blocking or elimination of data that is unnecessary or processed outside the law.
- To take your data to another provider (portability).
- To eliminate data processed on the basis of your consent.
- To know with whom we share your data.
- To know what happens if you do not consent.
- To withdraw your consent at any time.
- To object to processing carried out on the basis of legitimate interest.
- To request a review of a decision taken solely by a machine.
How to exercise them
To erase the data of this device there are two paths, and neither of them requires an e-mail or an account:
- Button inside the app: Settings → Privacy → Delete my data.
- Page on our website: www.tensorial.com.br/visionauta/excluir-dados. It exists for those who have already uninstalled the app and no longer have any button to press, and it can be operated with a screen reader.
Both of these paths remain available to everyone, with or without an account.
If you have an account, there is a third path, and it is the most complete one: Settings → Account → Delete account, inside the app. You confirm with your own login — e-mail and password, Google or Apple — and we erase the account, the entire archive — images, audio, transcripts, memories, sensors and derivatives — and the data of the devices linked to it, all at once. The login is the proof that it is you: nobody deletes your account knowing only the code of a device.
To turn off only the training switch (section 3.2), you do not need to delete anything: Settings → Account, and turn it off. It applies from then on.
Forgot your password? On the sign-in screen, use "Forgot my password" and enter your e-mail. We send a reset link to it. We never ask for your password by e-mail, message or phone call — if someone asks, it is not us.
For any other right: write to privacidade@tensorial.com.br.
Deadline: we reply within 15 days (art. 19, II). Simple confirmations are answered immediately.
What we need from you. If you do not have an account, we cannot link a request to a person by name. We need the identification code of your device, which is available inside the app under Settings → Privacy → Device identifier (the value can be copied right there). Without it, we cannot locate your data — and it is good that it is this way, because it means that nobody else can either. If you have an account, the login itself takes care of the identification.
What is not erased
Even after the deletion request — of a device or of the entire account —, we keep:
- The application access logs (IP address, date and time — not the content), for the 6 months that art. 15 of the Marco Civil da Internet obliges us to keep. It is not our choice: it is a legal obligation, and the deletion request does not annul it.
- The tax records of the subscription, for the 5 years the law requires.
- The record that you authorized or withdrew something, and the record of the deletion request itself, so that we can prove that we respected your choice.
Complaint to the ANPD
If you think we processed your data outside the law, you can petition directly to the National Data Protection Authority (ANPD), through the gov.br/anpd website. That right is yours regardless of coming to us first.
11. Children and adolescents
Visionauta is for people aged 12 and over. The Visionauta Account is only for people over 18 — creating the account requires confirmation of age, and an account created by a minor is closed, with deletion of the data.
We do not intentionally collect data from children under 12. If we learn that this has happened, we erase it.
Between 12 and 17 years old, use is in anonymous mode — no account, no storage of content — and the processing is carried out in the best interest of the adolescent, in accordance with article 14 of the LGPD. Data of people under 18 goes into no model training at all.
12. When this policy changes
As of this version, you have the following commitment: any change to this policy will be announced 30 days in advance, before it takes effect.
The notice arrives by two paths at the same time: push notification and notice inside the app.
A material change requires you to accept again. Material means: starting to process a new kind of data, changing a purpose, adding a new recipient of content, or extending a retention period. In those cases, you will see the new text and you will decide. Continued use does not replace acceptance.
Wording corrections that change nothing of substance do not require a new acceptance, but they are recorded.
Version history. Every version of this document is numbered and is available at www.tensorial.com.br/visionauta/versoes. When you accept, we keep the number of the version accepted — so the question "what did this person agree to?" has an exact answer.
13. Final provisions
Applicable law. This policy is governed by the laws of Brazil, in particular Law 13.709/2018 (LGPD).
Language. Translations of this policy exist. In case of divergence between versions, the text in Portuguese prevails.
Jurisdiction. The Central Courts of the Judicial District of São Paulo, SP, are hereby elected. If you are a consumer, this does not remove your right to sue in the courts of your own domicile, guaranteed by the Código de Defesa do Consumidor (Brazilian Consumer Protection Code).
